Last summer, Musk’s company xAI filed a lawsuit against Apple and OpenAI. The attempt to have this rejected immediately failed. According to the allegations, there is systematic discrimination against Grok in the App Store, whereas Apple clearly prefers its partner OpenAI. Allegedly, Apple refuses to devote similar attention to the Grok service as was the case with the constantly advertised ChatGPT, despite outstanding download numbers. The court found the argument to be “fundamentally sound”, but that does not mean agreeing with the points – a regular procedure is required for evaluation. As part of the taking of evidence, xAI and This does not mean a role as a defendant, but rather that Federighi’s emails, messages and other documents must be searched and, if necessary, released as likely relevant sources of evidence. The court only partially agreed to xAI’s request because Federighi becomes such a document controller in the proceedings, while Cook does not.
“Cook doesn’t know any more than Federighi”
The judge reasoned that Federighi, as Apple’s software chief, likely played a key role in integrating OpenAI services into Apple Intelligence. He therefore has potentially relevant information. For Tim Cook, on the other hand, xAI did not adequately explain which unique documents it could provide that were not already available through other sources, in particular Federighi. Apple must now submit relevant documents from Federighi’s possession by June 17, 2026. However, the same applies to Musk, because according to a request from OpenAI, he has to hand over certain emails and communications from Tesla and SpaceX accounts as well as other channels.
