In short: Apple to start more advertising in the App Store +++ OpenAI does not have to hand over the source code to xAI | News

As is well known, you will soon find a lot more advertising in the App Store. According to an announcement, instead of one placement at the top of the search results, several advertisements will appear. At the same time, Apple is experimenting with making the design of normal and paid results largely the same and eliminating the previous clear separation. Now the company gave further details about the schedule. Accordingly, the United Kingdom and Japan are the first to start, where the changeover will begin on March 3rd. But people in other countries won’t be spared for too long, as it should happen everywhere at the end of March. In order to use the opportunities for developers and visitors to the App Store, the devices must be running iOS or iPadOS 26.2. Existing campaigns do not need to be adjusted because booked placements are automatically distributed across the additional positions.
OpenAI does not have to hand over the source code to Musk
Since last fall, Elon Musk’s company xAI has been trying to prove that Apple and OpenAI have made some kind of pact. This means that only ChatGPT is available as an attachment for Siri, OpenAI is always preferred in the App Store anyway – but at least this had enough substance to not get a direct rejection in court (see article). The court documents reveal a counterargument from OpenAI. It states that Grok cannot be docked with Apple Intelligence because it lacks “technical aspects”.
xAI then tried to force OpenAI to hand over the code. In this way the aim was to prove that the statements were not true. However, the court decided otherwise and rejected the application. The OpenAI source code is irrelevant in this case. Disclosing such sensitive data is not proportionate. In addition, xAI has not made any attempts to obtain relevant information in less intrusive ways. The evidence for the allegations made can easily be collected without requiring complete access to the code.
