Terms & Conditions – Birchys Berlin Tours

1. Scope of Services

Birchy’s Berlin Tours provides guided tours and arranges travel-related services including accommodation, transport, and third-party activities on behalf of clients.

Certain services may be operated by independent suppliers. In such cases, the terms and conditions of those suppliers may apply in addition to these Terms & Conditions.


2. Booking confirmation

A booking is considered confirmed only after written confirmation has been issued and any required deposit has been received.

For group or multi-day arrangements, a deposit may be required to secure accommodation, guides, transport, and other services.

Birchy’s Berlin Tours reserves the right to decline a booking at its discretion prior to confirmation.


3. Payment Terms

Payment schedules will be outlined in the booking confirmation or invoice.

Unless otherwise agreed in writing:

  • A deposit is required to confirm group bookings.
  • The remaining balance must be paid prior to the start of services.
  • If booking is made within the final payment window, full payment is required at confirmation.

Failure to make payment by the due date may result in cancellation of services.


4. Cancellation by Client

All cancellations must be made in writing.

Cancellation charges are applied according to the applicable cancellation policy published at the time of booking. For group and multi-day bookings, cancellation charges may reflect commitments made to third-party suppliers.

No refunds are provided for unused services, late arrivals, or early departures.


5. Changes to Group Size

Prices for group bookings are based on the confirmed number of participants.

If the number of participants decreases after confirmation, the total price may be recalculated to reflect minimum supplier requirements and occupancy conditions.


6. Changes by Birchys Berlin Tours

In rare cases, it may be necessary to modify parts of an itinerary due to circumstances beyond reasonable control (including supplier availability, weather, operational issues, or safety considerations).

In such cases, reasonable alternatives of comparable standards will be provided where possible.


7. Third Party Services

Accommodation, transport providers, attractions, and certain activities may be operated by independent third parties.

Birchy’s Berlin Tours acts as an intermediary for such services unless explicitly agreed otherwise. The respective supplier’s terms and conditions may apply.


8. Liability

Birchy’s Berlin Tours shall not be liable for loss, damage, delay, or injury arising from acts or omissions of third-party suppliers, force majeure events, or circumstances beyond reasonable control.

Clients are responsible for ensuring they meet all travel requirements including visas, insurance, and valid travel documents.

Travel insurance is strongly recommended for all participants.


9. Force Majeure

Birchy’s Berlin Tours shall not be liable for failure to perform services due to events beyond reasonable control, including but not limited to natural disasters, government restrictions, strikes, transportation disruptions, or other unforeseeable events.


10. Governing Law

These Terms & Conditions are governed by the laws of the Federal Republic of Germany.

Any disputes shall be subject to the jurisdiction of Berlin, Germany, unless otherwise required by mandatory consumer protection law.

12. Limitations of Liability

Birchy’s Berlin Tours shall be liable for damages only in cases of intent or gross negligence.

In cases of ordinary negligence, liability shall be limited to foreseeable damages typical for the contract and shall not exceed the total amount paid by the client for the affected services.

Birchy’s Berlin Tours shall not be liable for indirect or consequential damages, including but not limited to loss of enjoyment, loss of opportunity, loss of profit, or additional costs incurred due to delays or disruptions caused by third parties.

Nothing in these Terms shall limit liability for:

  • Injury to life, body, or health,
  • Mandatory liability under applicable law,
  • Claims arising under the German Product Liability Act.

Clients participate in tours and activities at their own risk. Clients are responsible for ensuring they are physically capable of participating in the booked services.
